Privacy Policy
This Privacy Policy describes how Assembly Labs, LLC ("Assembly Labs," "we," "us," or "our") collects, uses, and shares information in connection with the TOMO mobile application and the website at traintomo.com (together, the "Service"). By using the Service, you acknowledge the practices described in this Privacy Policy. This policy should be read together with our Terms of Use.
1. Information We Collect
1.1 Information you provide
- Account information, such as your name, email address, and password.
- Profile information, such as belt rank, stripes, gym or academy, training goals and frequency, date of birth, gender, and, if you choose to provide it, body weight.
- Training content, such as session logs, notes, techniques, sparring details, goals, and other content you enter.
- Voice recordings you make when using voice logging, and transcripts created from them.
- Health and fitness information, such as your training activity and any injuries or physical conditions you mention in your entries.
- Communications, such as support requests, feedback, and any screenshots you choose to send us.
1.2 Information collected automatically
- Device and app information, such as device model, operating system, app version, and device or account identifiers.
- Usage information, such as the features and screens you use and actions you take in the app.
- Diagnostic information, such as crash reports, performance data, error logs, and information about the state of the app when an error occurs. Diagnostic information may be associated with your account so that we can respond to support requests.
- Approximate location, if you grant permission, used to suggest nearby gyms. We do not associate approximate location with your account.
1.3 Information from third parties
- Subscription information. If you purchase a subscription, we receive information about your subscription status from Apple and our subscription management provider. We do not receive your payment card details.
2. How We Use Information
We may use the information described above to:
- Provide, operate, and maintain the Service;
- Transcribe voice recordings and organize your entries;
- Generate insights, summaries, and recommendations based on your training history and profile;
- Understand how the Service is used, diagnose problems, and improve the Service;
- Manage subscriptions and account status;
- Respond to your requests and send you service-related communications;
- Protect the security of the Service, prevent misuse, enforce our Terms of Use, and comply with legal obligations; and
- Carry out other purposes with your consent.
3. How We Share Information
We do not sell your personal information, and we do not use it to track you across other companies' apps or websites for advertising. We may share information as follows:
- Service providers. We work with third-party companies that perform services on our behalf, including cloud hosting and storage, account authentication, speech-to-text transcription, artificial intelligence processing, analytics, error monitoring, and subscription management. These providers receive the information they need to perform those services and are permitted to use it only for that purpose.
- Apple. Purchases made through the App Store are processed by Apple under Apple's own terms and privacy policy.
- Legal and safety. We may disclose information if we believe in good faith that doing so is required by law or legal process, or is necessary to protect the rights, property, or safety of Assembly Labs, our users, or others.
- Business transfers. Information may be transferred as part of a merger, acquisition, financing, sale of assets, or similar transaction.
- With your consent or at your direction.
- Aggregated or de-identified information that cannot reasonably be used to identify you.
4. Voice Recordings and AI Processing
Voice logging and insights rely on third-party service providers. When you use the Service:
- Voice recordings are sent to a speech-to-text provider to create a transcript. We keep the transcript and delete the recording as soon as the transcript is created. If a recording cannot be transcribed, we hold it for up to 30 days so you can retry, then delete it.
- Transcripts, training entries, and related profile information, which may include your first name, belt rank, age, gender, body weight (if provided), gym, training history, and any injuries mentioned in your entries, are sent to a third-party artificial intelligence provider to organize your sessions and generate insights.
- Under its terms with us, our artificial intelligence provider does not use this content to train its models.
Insights and other AI-generated content are produced automatically, may be inaccurate or incomplete, and are not medical, health, or professional coaching advice. AI processing is central to how the Service works. If you do not want your entries processed in this way, please do not use the Service.
5. Data Retention
We keep information for as long as your account is active or as needed to provide the Service. You can delete your account at any time from within the app. When you do, we will delete or de-identify your personal information, including transcripts and any recording still waiting to be transcribed, within a reasonable period. Some information may remain for a limited time in backups or in the systems of our service providers, and we may keep information where needed to comply with legal obligations or resolve disputes. We may keep aggregated or de-identified information that does not identify you.
6. Security
We use reasonable measures designed to protect information, including encryption of data in transit and access controls on stored data. However, no method of transmission or storage is completely secure, and we cannot guarantee the security of your information. You are responsible for keeping your account password confidential. If we learn of a security incident affecting your personal information, we will notify you where required by applicable law.
7. Your Choices and Rights
- Access and correction. You can view and update your profile and training content in the app.
- Deletion. You can delete individual sessions, or delete your account from the Profile section of the app.
- Device permissions. You can turn off microphone and location access at any time in your device settings. Some features may not work without them.
- Additional rights. Depending on where you live, you may have rights under applicable law to request access to, correction of, deletion of, or a copy of your personal information, or to object to or restrict certain processing. To make a request, contact us using the details below. We may need to verify your identity before responding, and we will respond as required by applicable law.
8. Children
The Service is intended for adults and is not directed to anyone under 18. We do not knowingly collect personal information from anyone under 18. If you believe a person under 18 has provided us with personal information, please contact us and we will take steps to delete it.
9. Where Information Is Processed
Assembly Labs is based in the United States. Information is stored and processed in the United States and in other countries where our service providers operate, which may have different data protection laws than where you live.
10. Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date above, and for material changes we may provide additional notice, such as in the app or by email. Your continued use of the Service after an update means you accept the revised policy.
